1. Scope

These Terms and Conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with Dr. Pongratz GmbH.

The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the order process. By clicking the order button, you submit a binding offer for the products contained in the shopping cart. Confirmation of receipt of your order is sent by email immediately after the order is submitted.

We accept your offer within two days by

• sending a declaration of acceptance in a separate email, or

• processing the payment transaction by our service provider or the selected payment service provider. The timing of the payment transaction depends on the selected payment method (see "Payment").

The relevant alternative for you is whichever of the listed events occurs first.

3. Contract Language, Storage of Contract Text

The language(s) available for concluding the contract: German, English

We store the contract text in our systems, which are not accessible to you.

4. Delivery Conditions

We deliver within Germany.

4.2 Delivery Options

We ship the products to the delivery address specified in the order process.

We only deliver by shipping. Unfortunately, self-collection of the goods is not possible.

5. Payment

The following payment methods are generally available in our shop:

Advance Payment

If you select advance payment, we will provide our bank details in a separate email and deliver the goods after receipt of payment.

Apple Pay

To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have Apple Pay enabled, authenticate yourself with your credentials, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. Further information is provided during the order process.

Google Pay

To pay the invoice amount via the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have Google Pay enabled, authenticate yourself with your credentials, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. Further information is provided during the order process.

PayPal, PayPal Express

To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your credentials, and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after placing the order. Further information is provided during the order process.

PayPal may offer additional payment methods in your PayPal account to registered and selected PayPal customers at its own discretion. We have no influence on the offering of these options; any additional payment methods offered individually relate to your legal relationship with PayPal. Credit Card via PayPal

Your card will be charged by PayPal after the goods have been shipped.

Direct Debit via PayPal

Payment by direct debit via PayPal requires an address and credit check and is made directly to PayPal. By confirming the payment instruction, you grant PayPal a direct debit mandate. You will be informed by PayPal about the date of the debit (so-called prenotification). The account will be debited before the goods are shipped.

Purchase on Account via PayPal

Purchase on account via PayPal requires an address and credit check and is made directly to PayPal.

Purchase on Account via PayPal and Ratepay

Purchase on account via PayPal requires an address and credit check and is made directly to Ratepay GmbH, Franklinstraße 28-29, 10587 Berlin ("Ratepay").

6. Retention of Title

The product remains our property until full payment has been made.

7. Transport Damage

If goods are delivered with obvious transport damage, please report such defects to the carrier immediately and contact us without delay. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.

9. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
